Renewables

At Cooper Rural, an increasing volume of our workload relates to various proposed Renewable Schemes, such as Solar and Wind Turbines.

We act purely on behalf of the farmer or landowners only, our expertise range from:

  • Negotiating Heads of Terms and Option agreements on behalf of clients who have been approached by renewable developers expressing an interest in their land.
  • Negotiating Cable Easements where developers need to run lengths of cable through clients land, ensuring your interests are managed properly and fairly.
  • Agreeing Licences for both Intrusive & Non-Intrusive Surveys where developers require access to client land to undertake investigative work prior to the commencement of a Renewable Scheme, ensuring the clients’ position is protected in relation to losses & damages.
  • Negotiating Compensation for any losses or damages associated with Renewable Scheme surveys, such as archaeological digs, or borehole monitoring investigation works.

We have a strong knowledge of the Development Consent Order Process and how Nationally Significant Infrastructure Projects can utilise compulsory powers where necessary, and therefore we are well placed in negotiating the best possible outcomes for clients, even where there is a threat of an underlying compulsory purchase or access power under relevant statute.  Professional fees are often covered by the developer.
